The two ideas that matter most: the contact data you capture belongs to you and is your responsibility, and Mela never sends messages on your behalf.

1. The service

Mela is a lead-capture and follow-up tool for trade shows: it scans business cards, transcribes voice notes, organizes contacts and events, and drafts follow-up messages for you to review and send yourself. Mela offers a free tier and paid subscription plans, described in Billing, subscriptions, and fulfillment. Features may evolve, but we'll never quietly remove the core of what you paid for.

2. Your account

You need an account to use Mela. Keep your credentials secure and your account information accurate; you're responsible for activity under your account. You must be at least 16 and using Mela for business purposes.

3. Your content and who owns it

Everything you put into Mela, card images, contacts, notes, voice memos, inventory sheets, drafts, is yours. You grant us the limited license needed to run the service: storing your content, backing it up, and processing it through our service providers (for example, sending a card image to an AI provider for text extraction) when you invoke those features.

We don't use your content to train AI models, and our providers' commercial API terms prohibit them from doing so with API-submitted data.

4. Your responsibilities for captured contact data

Mela's core feature is storing other people's personal data, the details on the business cards you scan. That data is in your control, so the legal duties that come with it are yours. By using Mela you agree that:

  • You control the contact data you capture. When you scan someone's card, you are the controller of their personal data. You confirm you have a lawful basis to store and use it (a handed-over business card is a classic one), and you'll comply with the data-protection laws that apply to you (GDPR, CCPA, and equivalents).
  • Honor opt-outs and deletion requests. If a contact asks you to stop reaching out or to delete their details, you'll do so, including removing them from Mela.
  • Follow anti-spam law when you reach out. Follow-ups are sent from your own WhatsApp or email, so messaging laws (CAN-SPAM, TCPA, ePrivacy and equivalents) apply to you as the sender. Mela never sends messages on your behalf.
  • Review AI output before you rely on it. OCR extractions and drafted messages can contain mistakes. Check details and edit drafts before saving or sending.

5. No auto-send

Mela generates drafts only. Sending always happens from your own messaging tools (WhatsApp, email), under your own accounts, by your own action. This is a product guarantee and a term of this agreement: because you are always the sender, compliance with messaging and marketing laws (CAN-SPAM, TCPA, ePrivacy, and equivalents) is your responsibility.

6. AI-generated output

OCR extractions, transcriptions, tags, match suggestions, and drafted messages are generated by AI and can be wrong, a misread digit, a wrong-language nuance, an overconfident claim. Review AI output before saving contact details you'll rely on and before sending any message. Mela provides drafts and suggestions as-is; the decision to use them is yours.

7. Acceptable use

You agree not to:

  • Use Mela for anything unlawful, including harvesting personal data outside a legitimate business relationship.
  • Upload content that is malicious, infringing, or that you have no right to hold.
  • Probe, overload, scrape, or reverse-engineer the service, or resell access to it.
  • Circumvent usage limits or interfere with other users' accounts.

8. Shared content and objectionable material

Mela lets you share your card with other people (the QR exchange) and add events to a public directory that other users can see. Content you share or submit is your responsibility, and there is zero tolerance for objectionable content or abusive users. You must not share, submit, or upload anything unlawful, hateful, harassing, threatening, obscene, or otherwise objectionable, and you must not impersonate anyone.

You can report content and block a user from inside the app. We review reports and remove violating content and terminate the accounts of offending users, typically within 24 hours. Continuing to use Mela means you accept these rules.

9. Third-party services

Mela hands off to services we don't control, WhatsApp, your email client, the app stores, and uses the processors listed in the Privacy Policy. Their terms govern your use of them. We're not responsible for third-party services, but we choose our processors deliberately and list every one.

10. Mela's intellectual property

The Mela app, website, brand, and design are ours. These terms don't grant you rights to them beyond using the service. If you send us feedback or suggestions, we can use them without obligation, and with gratitude.

11. Termination

You can stop using Mela and delete your account at any time; deletion removes your data as described in the Privacy Policy. We may suspend or terminate accounts that violate these terms, with notice where practicable. Sections that by their nature survive (your responsibilities for data you exported, disclaimers, liability limits) survive termination.

12. Billing, subscriptions, and fulfillment

Mela offers a free tier and paid subscription plans (Mela Individual and Team plans). You can use the core of Mela for free within its limits, and subscribe when you want more.

How you buy, and how it is delivered

Subscriptions are sold through the app store you downloaded Mela from, the Apple App Store or Google Play, which acts as the seller and processes your payment. The price is shown in the app before you confirm, may vary by country, and can change over time. Nothing ships: paid features unlock inside the app immediately after the store confirms your purchase, and stay available for the period you paid for.

Auto-renewal

Paid plans are auto-renewing subscriptions. Each one renews automatically for the same period unless you turn off auto-renew at least 24 hours before the current period ends. Your store account is charged for the renewal within 24 hours before the period ends.

Managing and canceling

You manage or cancel your subscription in your App Store or Google Play account settings, where all of your store subscriptions live. Because the store is the seller, we cannot cancel or change a store subscription for you. Canceling stops future renewals, and your access continues until the end of the period you already paid for.

Team plans

On a Team plan, the person who buys the plan is the billing owner and is charged for it. Adding more seats may move you to a higher-priced tier, always shown before you confirm. Team members get unlimited access while the team's subscription is active, and that access ends if the subscription lapses or the owner switches plans.

Price changes

If we raise the price of a subscription you hold, the app store will ask for your agreement before the new price takes effect, as its rules require. If you do not agree, the subscription simply will not renew at the new price.

13. Refunds

Because your purchase is processed by the Apple App Store or Google Play, refunds are handled by them under their policies, not billed or refunded by Mela directly.

  • Apple. Request a refund at reportaproblem.apple.com, or through your App Store purchase history.
  • Google Play. Request a refund through the Google Play Store or Google Play's purchase help.

Where the law where you live gives you a statutory right to cancel or to a refund, such as the right of withdrawal in the EU and UK, that right still applies. If you have trouble with a refund you believe you are owed, email us at support@saymela.com and we will help point your request the right way.

14. Disclaimers

Mela is provided "as is" and "as available." To the maximum extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted, error-free, or that AI output will be accurate.

15. Limitation of liability

To the maximum extent the law allows, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues. Our total liability for claims arising out of the service is capped at the greater of USD 50 or the amount you paid us in the 12 months before the claim. Some jurisdictions don't allow certain limits, so parts of this section may not apply to you.

16. Indemnification

You'll defend and indemnify Mela against claims arising from the contact data you capture and how you use it, the messages you send, or your violation of these terms or applicable law, the flip side of that data being fully yours.

17. Governing law and disputes

These terms are governed by the laws of the State of Washington, excluding its conflict-of-law rules, and disputes belong to the state or federal courts located in Washington. Both parties waive the right to a jury trial to the extent permitted.

18. Changes to these terms

If we materially change these terms, we'll notify you in the app or by email before the changes take effect. Continuing to use Mela after that is acceptance of the updated terms.

19. Miscellaneous

If part of these terms is unenforceable, the rest stands. Our not enforcing a term isn't a waiver of it. You may not assign this agreement without our consent; we may assign it in connection with a merger or sale. These terms plus the Privacy Policy are the entire agreement between us about Mela.
